Taranaki seabed iron sand mining appeal being heard by the Supreme Court

 

Dawson and Associates has represented a consortium of fishing interests since 2013 in opposing an application for marine discharge consents.  

A decision-making committee of the Environmental Protection Authority (EPA) granted consent to discharge up to 50 million tons of sediment onto the seabed.  Fisheries interests, together with Iwi, KAZM, Greenpeace, Forest and Bird and others took this decision on appeal to the High Court which quashed the EPA decision to grant consent.  The iron sands miner (TTR) took this decision to the Court of Appeal where the High Court decision was affirmed and strengthened.  TTR have filed a ‘last ditch’ appeal to the Supreme Court against the ruling of the Court of Appeal.

This is an important matter as the Supreme Court’s ruling on the matter will determine how applications for mining and discharge consents are dealt with in the future.
